Terms and Conditions

  1. Acceptance of Policies:

Please read this document carefully (“Terms and Conditions”) before participating in the contest titled “VITTHAL BHAKTIGEET CONTEST” (“Contest”) conducted by Shemaroo Entertainment Limited (“Shemaroo/Us/We”) and hosted on the channel “Shemaroo Marathibana” (“Channel”). By participating in the Contest, the participants agree to be bound by these Terms & Conditions and represent that the participants satisfy all of the eligibility requirements set out herein below and adheres to the policies, rules and regulations. The participants hereby acknowledge that they have fully read these Terms and Conditions voluntarily, without coercion or any undue influence on the part of Shemaroo and with complete understanding. In case the participants do not agree to be bound or cannot comply with any of the Terms & Conditions, please do not continue to submit your entries. The participants’ failure to comply with the provisions of these Terms & Conditions will disqualify such participant from participating in the Contest. The decision of Shemaroo for all matters relating to participation shall be final and binding in all respects.

The Contest shall be conducted on daily basis between 5th July 2021 to 20th July 2021 (both dates inclusive) (“Contest Period”). The Contest will run on the Channel throughout the day during the Contest Period.

These Terms and Conditions govern the participation in this Contest, organized and conducted by Shemaroo. By participating in this Contest, it is deemed that the participants have read, understood, accepted and agreed to irrevocably and unconditionally abide by and be bound by all the terms and conditions of this Contest, including these Terms and Conditions. Failure to accept or comply with the provisions of these Terms & Conditions will disqualify a participant from the Contest. By proceeding further, the participants are representing to Shemaroo that their participation in the Contest is in compliance with all laws applicable and that they are not in any manner prohibited from participating herein by any law. Non-compliance with the provisions of these Terms & Conditions by any participant will disqualify such participant from the Contest.

These Terms and Conditions shall be irrevocably binding on each participant(s) voluntarily participating in the Contest. The participants may be required to provide basic personal information about themselves including but not limited to Participants name, address, telephone number or mobile number and email address (“Data”) in order to participate in the Contest. The information provided by the Participants may be used by Shemaroo for internal purposes and to send to the Participants promotional information pertaining to future contests, promotional information, etc. By participation in the Contest, the participant(s) hereby consents to the collection, storage, disclosure, processing, transfer of and sharing of the personal information and Data by Shemaroo, its affiliates, and designated third parties.

  1. Contest Rules:

  1. Eligibility Criteria

    1. The Contest is open only to Indian citizens, residing in India. Citizens and/or residents of countries are not eligible to participate.

    1. The Participants must be adults having attained the age of eighteen (18) years to participate in the Contest as on the date of the Contest:

  1. Contest:

    1. Lord Vitthal is the only God whom we Maharashtrians fondly call Mauli, meaning mother, such is the relation his devotees have with him. It is difficult to find a Maharashtrian who does not know a song, praising lord Vitthal. Listing to these songs is nothing short of divine experience. Hence, the Channel has come up with an on-air and social media activity where people of Maharashtra will create the longest bhaktigeet for their beloved Vithu Mauli.

    1. The first two (2) lines of the song will be provided by Shemaroo on the Channel through Aston bands and on the social media platforms (Facebook and Instagram) of the Channel.

    1. The Participants who are desirous of participating in the Contest will have to send the next two (2) lines of the song which would go very well with the first 2 lines provided by Shemaroo on the social media platforms (Facebook and Instagram) of the Channels and on the Channel’s official WhatsApp number 7710055055.

    1. After the completion of the Contest Period and after selecting the best entries received, Shemaroo will produce a song collating the best two (2) lines received from the participants, making it longest devotional song created by people of Maharashtra.

 

  1. Selection & Shortlisting Process

    1. Participants can send in as many entries as they wish. However, Shemaroo will select such entries that will be deemed the best entries by Shemaroo.

    1. Right to select the best two (2) lines from the entries received from various participants is at the sole discretion of Shemaroo. Any decision taken by Shemaroo related to the Contest cannot be challenged by any of the participant.

 

    1. Shemaroo shall have the sole right at its sole discretion to disqualify a participant and/or a winner, in the event it is found that the entries of the participants are plagiarizing or infringing the intellectual property rights of a third party.

  1. Winner Announcement and Prize

    1. The participants, whose two (2) lines are selected to be part of the song, will be communicated by Shemaroo.

    1. The name of each of the winners, whose two (2) lines will be selected to be part of the song, will be announced on the social media (Facebook and Instagram) page of the Channel and also the names of the winners will be given credit on the Aston band while telecasting the songs on the Channel.

 

    1. There will be no cash prize or cash consideration given to the winners of the Contest. The participants confirm and agree that announcement of the winners’ name on the social media (Facebook and Instagram) page of the Channel and receiving credit by displaying the name of the winners on the Aston band while telecasting the songs on the Channel is sufficient consideration towards participation in the Contest. However, in the event Shemaroo fails to announce the names of the winners on the social media (Facebook and Instagram) page of the Channel or display the names of the winners on the Aston band while telecasting the songs on the Channel, the winners will have no claim against Shemaroo in any manner whatsoever.

  1. General Terms and Conditions:

  1. The participants and the winners agreed, confirm and acknowledges that, from the date of submission of the two (2) lines by the participants, the submission of the two (2) lines (“Work”) shall at all times constitute and shall be deemed to be “work-made-for-hire”/ “commissioned works” and Shemaroo shall be the author and the first, absolute and exclusive owner of all rights in the Works for all purposes, for the entire territory of the world and in perpetuity.

  1. To the extent that the Works are not considered to be ‘work’ under the Indian Copyright Act, 1957, or similar provisions of any other statute or law prevailing in any other part of the world, then it shall be deemed that all rights in the Work not considered as ‘work’, have been hereby exclusively, unconditionally and solely assigned to Shemaroo in perpetuity for exploitation across all modes, media and formats for the entire world.

 

  1. To the extent that it is finally judicially pronounced that Shemaroo is not the first and exclusive owner of the Work or any of the rights in the Work, then the participants acknowledge and agree that all such rights in the Work which are pronounced to be not vesting in Shemaroo shall be deemed to have been exclusively, solely and unconditionally assigned to Shemaroo in perpetuity for exploitation across all modes, media and formats for the entire world.

 

  1. The participants hereby unconditionally and irrevocably waives all rights of “droit moral” or “moral rights of authors” or “artist’s rights”, or author’s special rights or any similar rights in and/or to the Work, in favor of Shemaroo and the enforcement thereof, and all claims and causes of action of any kind with respect to any of the foregoing. The participants expressly agree that the provisions of Section 19(4) and 19A read with 30A of the Indian Copyright Act, 1957 or similar provisions of any other statute or law prevailing in any other part of the Territory shall not apply and the participants hereby waive its rights under the aforesaid sections/ statutes/ laws.

 

  1. All the rights vested in Shemaroo are vested to its fullest extent and the participants agree that no right(s), of whatsoever nature are retained with the participants, by way of any reservation, limitation or retention. Without prejudice to the foregoing, the participants hereby grant irrevocably and unconditionally to Shemaroo, all consents which may be required pursuant to any act, law or regulation now or in the future in force in any part of the universe, including, without limitation, performers’ consents, to enable Shemaroo to make the fullest use of the Work and the widest possible exploitation of the Work as contemplated herein. The participants hereby agree to do any and all acts and execute any and all documents, in such manner and at such location as Shemaroo may, in its sole discretion, require in its interest to protect, perfect, confirm or enforce the existence of the rights in the Work.

 

  1. The participants represent and warrant that:

 

  1. The Work is and shall be original and solely created by the respective participants and any third- party claim which shall be raised on the Work and/or part thereof shall be solely resolved by the respective participant at its sole cost and expense without any recourse to Shemaroo in any manner whatsoever;

  2. The Work and no part thereof is and shall be plagiarized or copied from third party works and does not and shall not violate or infringe any copyright, artistic and /or personal rights of any other person;

  3. They shall not encumber or dispose of any of the rights and/or Work and the participants shall not do anything that would affect the rights of Shemaroo in the Work that are vested in Shemaroo or cause the warranties, representations or undertakings of the participants to be or become untrue or incapable of being fulfilled;

  4. The participants are competent to enter into the Contest and submit the entries and are not prevented in law or contract in any manner whatsoever;

  1. Shemaroo is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, loss, outrage, dissatisfaction, death, mental trauma caused to the participant(s) and/or the winner in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Prize.

  1. FORCE MAJEURE: This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, pandemic, epidemic, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of Shemaroo (“Force Majeure Event“). Shemaroo shall be not liable for any delay or adverse effect caused to the participants in the Contest including the winners as a result of a Force Majeure Event.

  1. PUBLICITY RELEASE: By participating in the Contest, you give Shemaroo and/or its affiliates permission to use your name, likeness, image, voice, and / or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Contest and any promotions, events, or contests to follow. You agree that Shemaroo and / or its affiliates has the right to publish your saved item details for any communication, promotions, events, or contests that follow. You agree that Shemaroo and / or its affiliates has complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release Shemaroo and/or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to Shemaroo and / or its affiliates and its agents and assigns to use your name and likeness to promote the Contest and any promotions, events, or contests to follow.

  1. LIABILITY RELEASE: This Contest is being made purely on a “best effort” basis and participation in this Contest is voluntary. By participating in the Contest, you will be legally bound hereby, to release from liability, and hold harmless Shemaroo, its affiliates and any of their employees, directors, agents, representatives or successor and its services for any matters in relation to this Contest, including the Prize and/or benefits. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the Prizes offered under this Contest, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Contest, even if caused or contributed to by Shemaroo’s negligence. By participating in this Contest, you agree to bear all the personal taxation that might arise out of the winnings from this Contest and shall not hold Shemaroo responsible for payment of the same and / or any dispute arising in relation thereof.
